Conditions of Use

General Terms of Business and Delivery of the company Kräuter Kühne GmbH

1. Exclusiveness
Orders of all kind are subject to our General Terms of Business and Delivery.

2. Order confirmation
Our e-mail confirmations and invoices are - except when otherwise stipulated - at the same time order confirmations.

3. Prices and invoices
With this online shop, all other preceding catalogues/online offers lose their validity. We reserve the right to change our prices due to the insecure price situation on the world markets caused by currency fluctuations, natural catastrophes and bad harvests. The invoiced amounts including value added tax have to be paid in EURO (€).

4. Delivery / Minimum ordering value:
Deliveries are effected as long as merchandise is available. We deliver ex works. The minimum ordering value is € 20.00 plus € 4,00 postage charges within Germany (DHL). If the customer requests another delivery service, the really arising fees will be charged. Delivery free of charge from an ordering value of € 35.00 onwards.
For deliveries with a value below the minimum ordering quantity we have to charge an extra fee for small-value purchase amounting to € 3.00.

5. Discounts
From an ordering value of € 50.00 onwards, we grant a cash discount of 5 %.
From an ordering value of € 75.00 onwards, we grant a cash discount of 8 %.
From an ordering value of € 100.00 onwards, we grant a cash discount of 10 %.
Trading discounts will separately be given after successful registration and check.

6. Right of revocation
Customers may exercise their right of revocation within two weeks either in written form (for example, letter, facsimile, e-mail) or by return of the goods without giving any reason for the revocation. The period of revocation shall commence with the receipt of the instructions for revocation in written form, but with receipt of the goods at the earliest.

For keeping the period of revocation, it shall be sufficient to send a notice of revocation or to return the goods in time. Notice of revocation and returned goods shall be directed to:

7. Consequences of revocation
In the event of a valid revocation, each party shall return to the respective other party the services and possible benefits received (for example: interests). If you cannot return the whole services or goods, but only parts of them or in a degraded condition, you are obligated to pay compensation. This may not apply to the return of goods, if the degradation is exclusively caused by checking the goods - what you would have done in the retail shop, too. Anyway, you may avoid the obligation for compensation if you do not start using the product as your own property and if you avoid doing everything what reduces the value of the product. You have to bear the freight charges for returning goods, if the delivered goods comply with the ordered goods and if the value of the returned goods does not exceed € 40.00 or if in case of goods with a higher commercial value you did not provide a return service or an agreed partial payment. Otherwise the return of goods shall be free of charge for you.
Goods, which cannot be returned by parcel, will be collected from you. You have to fulfil possible obligations for payment within 30 days after having sent your notice of revocation.

8. Warranty
In the event that the goods delivered to the Customer have any defects as regards to material or production, including transport damages, please complain about these defects immediately to us or to the carrier who supplies the articles to you. Anyway, the failure to claim any defects does not have consequences on your legal rights to claim under guarantee. For all kinds of defects of goods occurring during the legal period of guarantee, the customer may make use of the right of subsequent performance, rectification of the defect or replacement and - the existence of respective legal stipulations provided - of abatement or withdrawal and besides this of indemnities including the compensation for damages and for your possible efforts in vain.

9. Deliveries going abroad
Transport charges for delivery going abroad will be calculated depending from the destination country and the total weight of the ordered goods.

10. Terms of payment

For initial orders (within Germany):
Payment by credit card (MasterCard or Visa Card), direct debiting system or payment by remittance in advance after receipt of the invoice. Delivery of the ordered goods will be effected after receipt of the invoiced amount at one of our accounts mentioned below.

For subsequent orders (within Germany):
Payment by credit card (MasterCard or Visa Card), direct debiting system or payment by remittance within 14 days after date of issuing the invoice.

Purchase by direct debiting system (within Germany):
If a direct debit is rejected by the bank due to incorrect bank details, insufficient funds in the account or other reasons being in the responsibility of the customer, we shall be entitled to claim a reimbursement for a return debit note amounting to € 8.00.

For our international customers:
Payment by credit card (MasterCard or Visa Card) or payment by cheque or remittance in advance after receipt of the invoice.

Attention: For payments by cheque or remittance through a foreign bank or in a foreign currency, additional bank charges of presently € 9.00 have to be paid.

12. Delay in payment
In case of delayed payment we raise default interests amounting to 5 % over the respective discount rate of the Federal Bank of Germany, if not a higher loss on interest can be proved by our part or a lower loss on interest can be proved by the orderer in the specific case.

13. Reservation of proprietary rights
The copany Kräuter Kühne GmbH shall remain owner of the goods until their complete value is paid.

15. Data protection
The personal data provided by the Customer at the beginning of or during the course of business dealings shall be processed and, in particular, stored in compliance with the provisions of the German Federal Data Protection Act (Bundesdatenschutz-gesetz). The Customer is entitled to have his or her personal data deleted or corrected at any time. Personal data shall not be passed on to a third party.

16. Legal domicile, place of fulfilment, salvatory regulation
Any business deals effected by using this online shop shall be governed by German law, without recourse to the UN Convention on Contracts for the International Sale of Goods, even if the Customer places an order from abroad or goods are delivered to an address outside Germany. If the customer is a merchant or has his domicile or habtual residence abroad, the place of jurisdiction for any claims arising from on order shall be the court of law Berlin-Schöneberg.

If individual stipulations of these General Delivery Terms become invalid, the other stipulations shall remain valid. The missing or invalid stipulation shall be replaced by a stipulation which meets most the economic purpose of the invalid stipulation intended by the parties.

17. Presentation and content of the online-shop
The data offered in this online shop are intended for information of our customers only. It is not allowed to use parts or the complete content of this shop for publication or advertising of third parties. We reserve the right to make changes or amendments to this homepage or product changes.
